Terms of Service
[Effective date: to be set at launch]
About these terms
These terms are an agreement between Brothers Aviation Inc., 35 ch. Edelweiss, Wakefield, Quebec J0X 3G0, Canada ("we", "us") and the customer who opens a PilotKeep account ("you"), and they also apply to every person invited into that account. By creating an account or using PilotKeep you accept them. If you accept them for an organization, you confirm you may bind it.
The service
PilotKeep is an online service for keeping aircraft records: maintenance reminders, snags and sign-offs, bookings, flights, journey logs, pilot logbooks, documents, receipts, cost sharing and inventory. We may improve and change features over time; we will not remove a core feature you pay for without notice.
Your records and airworthiness
PilotKeep helps you keep and organize records; it does not replace the judgment of the pilot in command, the aircraft owner or an aircraft maintenance engineer, or the records and approvals the law requires. You remain responsible for the airworthiness of your aircraft, for compliance with the Canadian Aviation Regulations and any other applicable rules, and for checking that what you enter (meter readings, intervals, due dates) is correct. Reminders, estimates and reports are aids only.
Accounts and people
- The person who opens the account is its first administrator. Administrators invite people, choose their roles and can remove them.
- Keep sign-in links and access to your email secure, and tell us at support@pilotkeep.com if you think someone used your account without permission.
- You must give accurate information and be at least 18, or the age of majority where you live, to open an account.
Free trial, plans and payment
- Every new account starts with a 30-day free trial with every feature. No card is needed for the trial.
- Plans are billed monthly in Canadian dollars: Owner $29 CAD per month (1 aircraft, unlimited users); Fleet $99 CAD per month (unlimited aircraft, unlimited users), plus applicable taxes (GST/HST and QST).
- Payment is by card through Stripe, charged at the start of each monthly period. There is no contract: you can change plans or cancel any time, and cancelling stops the next renewal. [Refund policy for a partial month: to decide].
- If a payment fails we will tell you; if it is not fixed, we may suspend the account until it is.
- We may change prices with at least 30 days' notice by email; the new price applies from your next period after the notice.
Your data
You own the records you put in PilotKeep. You give us the right to store, process and display them only to provide the service to you. You can export your records to PDF or CSV at any time. After an account is closed we delete its records as described in our Privacy Policy.
Acceptable use
Do not use PilotKeep to break the law, to store content you have no right to, to try to reach other customers' data, to overload or attack the service, or to copy or resell it.
Availability and support
We work to keep PilotKeep available and your records safe, but the service is provided without a guarantee that it will always be available or error-free. Keep exports of records you must not lose. Support is by email at support@pilotkeep.com.
Liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for decisions about the operation or maintenance of an aircraft, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights that consumer protection law, including Quebec's Consumer Protection Act, gives you and that cannot be waived.
Ending the agreement
You may close your account at any time. We may suspend or close an account that breaks these terms, after notice when possible. We will give at least 60 days' notice before ending the service as a whole, so you can export your records.
Changes to these terms
We will post changes here with their date and tell account administrators by email at least 30 days before an important change takes effect.
Law and language
These terms are governed by the laws of Quebec and of Canada that apply there, and the courts of Quebec have jurisdiction. These terms are available in French and English. [Which version prevails if they differ: lawyer to confirm]
